Protection of Personal Data

Information Notice for Website Visitors

Özmer Pastry and Beverage Products Industry, Marketing, Tourism and Foreign Trade Inc. (Özmer), as the data controller, processes your personal data in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK) and relevant legislation.

Pursuant to Article 10 of the KVKK regulating the obligation to inform, data controllers are required to inform the relevant persons whose personal data they process on certain matters.

This information notice has been prepared in accordance with the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform published by the Turkish Data Protection Authority, in order to fulfill the legal obligation.

Definitions

According to the Personal Data Protection Law No. 6698:

Personal data refers to any information relating to an identified or identifiable natural person.

Processing of personal data refers to any operation performed on personal data such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing the use of data, whether fully or partially automated or non-automated provided that it is part of a data recording system.

Data subject refers to the natural person whose personal data is processed.

Data controller refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.

Obligation to inform refers to the obligation of the data controller or the authorized person to inform the data subjects about the identity of the data controller, the purposes of processing personal data, to whom and for what purposes the processed personal data may be transferred, the method and legal basis of data collection, and the rights listed in Article 11 of the Law.

Data Subject

You, whose personal data is processed by Özmer due to visiting our website, are defined as a Website Visitor and are accepted as a Data Subject under the Law.

Data Controller

Özmer is the data controller responsible for determining the purposes and means of processing personal data related to you and for establishing and managing the data recording system.

Collection of Personal Data

Your personal data is collected through the websites ozmer.com and limpo.com.tr via digital environments using fully or partially automated methods. Documents submitted physically are collected through non-automated methods. These processes occur through methods such as visiting the website, filling out forms, or sending physical documents via mail or other means.

Automated data processing refers to processing activities carried out automatically by devices with processors such as computers or phones, without human intervention, based on predefined algorithms. Partially automated processing involves human input but is still carried out via such devices. Only personal data processed through non-automated methods that are part of a data recording system fall within the scope of the Law.

Processed Personal Data, Purposes and Legal Grounds

Website Usage

Due to your use of our website, we process certain personal data including:

  • Website traffic data and transaction security data (connection time, visited pages, IP address, etc.)

For purposes of ensuring compliance with legislation, creating and monitoring visitor records, conducting information security processes, and carrying out storage and archiving activities, based on Article 5/2(a) of the KVKK (explicitly stipulated by law) and pursuant to Article 4 of Law No. 5651 on the Regulation of Publications on the Internet.

Requests – Complaints and Communication

Requests, complaints and inquiries submitted via contact forms, email or other channels, together with your identity and contact information, are processed for purposes of after-sales support services, communication activities, tracking requests/complaints, and storage and archiving activities, based on Articles 5/2(e) and 5/2(f) of the KVKK.

Transfer of Personal Data

Your personal data may be transferred to authorized public institutions without the obligation to inform and without requiring explicit consent in accordance with Article 28/1 of the KVKK.

In unforeseeable circumstances, your personal data may also be transferred to relevant public authorities as explicitly stipulated by law, within the limits of legal purposes.

Apart from legal obligations, certain data regarding your website activities, preferences and choices may be transferred to third-party cookie providers through cookies. Detailed information is available in the Cookie Information Notice.

Your Rights Regarding Personal Data

Pursuant to the Law, you have the right to:

  • Learn whether your personal data is processed

  • Request information if processed

  • Learn the purpose of processing and whether it is used in accordance with that purpose

  • Know third parties to whom data is transferred

  • Request correction of incomplete or inaccurate data

  • Request deletion or destruction of data when reasons for processing cease

  • Request notification of corrections/deletions to third parties

  • Object to adverse results arising from automated processing

  • Claim compensation for damages due to unlawful processing
